Race Waiver & Release of Liability
Important: This waiver is a binding legal agreement. Please read it carefully before completing your registration. You will be required to acknowledge and accept this waiver as part of registering for the Malad Valley Marathon. Participants under 18 years of age must have a parent or legal guardian sign on their behalf.
This is a draft template. The Malad Valley Marathon will have this document reviewed by qualified legal counsel and our race insurance provider before the start of the registration period.
1. Assumption of Risk
I understand that running and participating in the Malad Valley Marathon, Half Marathon, 10K, 5K, or 1 Mile Fun Run (the “Event”) is a potentially hazardous activity that carries with it the risk of serious bodily injury, permanent disability, paralysis, or death. I voluntarily assume all such risks, both known and unknown, including but not limited to: falls; contact with other participants, vehicles, animals, or fixed objects; the effects of weather (extreme heat, cold, sun exposure, wind, lightning, precipitation); the conditions of roads, trails, and other surfaces (loose gravel, uneven pavement, mud, ice); traffic; equipment failure; inadequate safety equipment; cardiac events, heat illness, dehydration, hyponatremia, and other medical conditions arising during exertion; and the actions of other participants, spectators, volunteers, race officials, or sponsors.
I certify that I am physically fit and sufficiently trained for participation in the Event, that I have not been advised against participation by a qualified medical professional, and that I am aware of the demands the Event will place on my body.
2. Release of Liability and Indemnification
In consideration of being permitted to participate in the Event, I, for myself, my heirs, executors, administrators, and assigns, hereby release, waive, discharge, indemnify, defend, and hold harmless the Malad Valley Marathon, its organizers, race directors, officers, employees, volunteers, sponsors, the City of Malad, Oneida County, the State of Idaho, the Idaho Transportation Department, all other municipalities and government agencies whose property or personnel are used or hosted, and all other persons or entities associated with the Event (collectively, the “Released Parties”), from any and all claims, demands, losses, damages, costs, expenses (including attorneys’ fees), liabilities, or causes of action of any kind arising out of or related to my participation in the Event, INCLUDING THOSE CAUSED BY THE ORDINARY NEGLIGENCE of the Released Parties, to the fullest extent permitted by Idaho law. I understand that this release does not extend to claims arising from the gross negligence, recklessness, or willful misconduct of the Released Parties.
3. Medical Authorization and Emergency Treatment
I authorize the Event’s medical personnel, race officials, and any emergency medical services dispatched to the Event to provide such first aid, medical care, hospitalization, or transportation as they reasonably deem necessary in the event of injury or illness during my participation. I agree to be financially responsible for any medical care I receive. I represent that I have adequate medical insurance to cover any injury or damage I may suffer and agree to bear those costs personally if I do not. I will inform race staff of any pre-existing medical conditions, allergies, or medications relevant to emergency care by listing them in my registration or on my bib.
4. Photo, Video, and Likeness Release
I grant the Malad Valley Marathon and its designees the irrevocable, perpetual, royalty-free, worldwide right to photograph, film, record, and otherwise capture my image, likeness, voice, name, biographical information, and performance during the Event, and to use those recordings in any medium now known or later developed for any lawful purpose, including but not limited to marketing, promotion, fundraising, news coverage, social media, and historical records of the Event. I waive any right to inspect or approve the finished product and any right to compensation arising from such use.
5. Course Rules and Conduct
I agree to obey all course rules, instructions from race officials, volunteers, law enforcement, and traffic control personnel, and all applicable traffic laws. Specifically:
- No banditing. I will only participate in the distance for which I am registered, wearing my assigned bib. Bib transfers, swapping, or running under another person’s bib are prohibited and grounds for disqualification and a permanent ban from future Events.
- No headphones during the marathon and half marathon. For the safety of myself, other participants, and traffic-control volunteers on open road segments, I will not wear headphones, earbuds, or any other audio device that obstructs my ability to hear instructions or oncoming traffic during the full marathon and half marathon distances. Headphones are permitted on the 10K, 5K, and 1 Mile Fun Run at my own risk.
- No performance-enhancing substances. I certify that I have not used any substance prohibited by the World Anti-Doping Agency (WADA) Prohibited List or U.S. Anti-Doping Agency (USADA) regulations, and I consent to drug testing if selected. Violations may result in disqualification, forfeiture of awards, and a ban from future Events.
- No personal vehicles, bicycles, skateboards, scooters, roller skates, or pets on the course (except certified service animals and authorized race-support vehicles).
- Strollers are permitted in the 5K and 1 Mile Fun Run only and must start at the back of the field.
- Course cutoffs. I understand published cutoff times will be enforced for runner safety and to permit reopening of public roads. Participants behind cutoff may be transported to the finish.
6. Weather, Cancellation, Course Modification, and Refunds
I understand the Event will take place rain, snow, shine, or otherwise. The race director reserves the sole right, in the interest of participant safety, to delay, shorten, modify, reroute, or cancel the Event in whole or in part due to weather, wildfire smoke, road conditions, public-health emergency, civil unrest, force majeure, or any other circumstance beyond reasonable control. Entry fees are non-refundable and non-transferable to a future year regardless of cancellation, modification, or my inability to participate, except as expressly stated in the Event’s published refund policy. I acknowledge that the costs of producing the Event are largely incurred in advance and a portion of every entry fee supports the Malad Valley community whether or not the Event is held.
7. Personal Property
I understand the Event provides gear-check at my own risk and disclaims responsibility for the loss, theft, or damage of any personal items, vehicles, or equipment brought to the Event venue.
8. Parent / Legal Guardian Consent (Participants Under 18)
If the participant is under 18 years of age at the time of the Event, this waiver must be signed by a parent or legal guardian. By signing on behalf of a minor, the parent or guardian represents that they have the legal authority to do so, agrees to all terms of this waiver on behalf of the minor, accepts personal responsibility for the minor’s safety and conduct during the Event, and agrees to indemnify the Released Parties for any claim brought by the minor (or on the minor’s behalf) arising out of the minor’s participation. The 1 Mile Fun Run is open to all ages; the 5K and 10K to participants age 8 and older; the half marathon to participants age 14 and older; the full marathon to participants age 16 and older. Minors under age 12 in the 5K, 10K, half marathon, or full marathon must be accompanied on course by a registered adult.
9. Governing Law, Venue, and Severability
This agreement shall be governed by and construed under the laws of the State of Idaho without regard to conflict-of-law principles. Any dispute, claim, or cause of action arising out of or related to the Event or this waiver shall be brought exclusively in the state courts of Oneida County, Idaho, or the United States District Court for the District of Idaho, and I consent to the personal jurisdiction of those courts and waive any objection to venue. To the fullest extent permitted by law, I knowingly and voluntarily waive my right to a trial by jury in any such proceeding. If any provision of this waiver is held unenforceable, the remaining provisions shall continue in full force and effect, and the unenforceable provision shall be reformed only to the extent necessary to make it enforceable.
10. Entire Agreement
I have read this entire Waiver and Release of Liability, fully understand its terms, understand that I have given up substantial rights by agreeing to it, and accept it freely, voluntarily, and without any inducement. By completing my registration and submitting payment, I affirm my electronic acceptance of this waiver, which shall have the same force and effect as a handwritten signature.
